By accessing or using Pollyanna ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Pollyanna is a free online tool that helps users organize Secret Santa and gift exchange events. The Service allows users to:

• Create gift exchange groups
• Add participants with their contact information
• Randomly assign gift givers to recipients
• Send notifications via email and/or SMS
• Share wishlists between participants

3. User Responsibilities

When using Pollyanna, you agree to:

• Obtain consent: Only add participants who have given you permission to include them in the gift exchange and to receive notifications
• Provide accurate information: Ensure contact information (email addresses and phone numbers) is accurate and belongs to the intended recipients
• Use the Service lawfully: Not use the Service for any illegal or unauthorized purpose
• Respect others: Not add anyone to a gift exchange without their knowledge or consent

4. SMS Messaging Consent

By adding a phone number for a participant, you represent and warrant that:

• You have obtained explicit consent from the participant to receive SMS notifications about the gift exchange
• The phone number belongs to the participant and they are expecting to receive communication about this gift exchange
• You understand the participant will receive a one-time SMS notification when names are drawn

Message and data rates may apply. Participants can opt out at any time by replying STOP to any message.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Pollyanna and are protected by copyright, trademark, and other intellectual property laws.

7. User Content

You retain ownership of any content you submit to the Service (such as wishlist items). By submitting content, you grant us a license to use, display, and share that content as necessary to provide the Service (e.g., sharing your wishlist with your Secret Santa).

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• All notifications will be delivered successfully
• The random assignment algorithm will meet all preferences

9. Limitation of Liability

To the maximum extent permitted by law, Pollyanna shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:

• Failed or delayed message delivery
• Unintended disclosure of gift assignments
• Any issues arising from gift exchanges organized through the Service

10. Termination

We reserve the right to terminate or suspend access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by posting a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
